Terms of Service

1. Acceptance

By accessing or using mkdshare.DEV ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These terms apply to all visitors, account holders, API users, and anyone who accesses documents or comments through the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

3. Accounts, Sign-In, and API Tokens

The Service uses Google OAuth for sign-in. You are responsible for maintaining the security of your Google account, active sessions, API tokens, MCP clients, and any third-party tools you connect to the Service.

API tokens authenticate requests as you. Any action performed with your token, including actions by an AI assistant or MCP client, is treated as an action by your account. Keep tokens secret and regenerate them if they may have been exposed.

We may suspend, restrict, or terminate accounts or tokens at any time if we believe they violate these terms, create risk for the Service, or are being misused.

4. Pricing and Changes

mkdshare.DEV is currently provided free of charge. We may introduce pricing, limits, paid plans, or feature restrictions in the future. We will provide reasonable notice where practical. Continued use of the Service after a change takes effect means you accept the changed terms or pricing.

5. Your Content

You retain ownership of the markdown documents, annotations, replies, and other content you submit to the Service. By submitting content, you grant mkdshare.DEV a non-exclusive, worldwide, royalty-free licence to store, process, display, transmit, render, version, back up, and otherwise use that content as needed to operate, secure, maintain, and improve the Service.

You are solely responsible for your content and for making sure you have the right to publish or share it. Do not submit content that:

  • is illegal or facilitates illegal activity;
  • infringes intellectual property, privacy, confidentiality, or other rights;
  • contains confidential, regulated, or sensitive information you are not authorised to share;
  • is defamatory, harassing, threatening, abusive, or deceptive;
  • contains malware, spam, phishing, or attempts to exploit the Service; or
  • you do not have the right to share with the audience you select.

We may remove, restrict, or disable access to content at any time if we believe it violates these terms, creates legal or security risk, or harms the Service.

6. Sharing, Access Controls, and Collaboration

The Service lets you create public, login-required, email-restricted, domain-restricted, and expiring document links. Public documents can be viewed by anyone with the link and may be discovered, indexed, copied, or shared by others. Do not publish private or confidential material as a public document.

Access controls are provided for convenience and are not a substitute for your own security review. Users who have access to a document may be able to read its content and comments. Users listed in a document's allowed email list may also be able to edit that document. Document owners are responsible for choosing appropriate visibility settings and collaborators.

Archiving a shared document for your own account does not delete it for the owner or for other authorised users. Expired documents may remain stored even after they are no longer viewable through normal access.

7. Comments and Version History

The Service supports annotations, replies, resolved comments, and document version history. Comments may show the author's name and profile picture to users who can access the document. Version history may retain earlier document content, titles, visibility settings, allowed emails, allowed domains, and expiry dates.

If you edit or delete current content, earlier versions or related records may still exist unless we delete them as part of account or data deletion handling.

8. API, MCP, and AI Assistant Use

The Service provides REST API and Model Context Protocol (MCP) access. You are responsible for how your AI assistants, MCP clients, scripts, and integrations use the Service. You should review content before publishing it, especially when it was generated or modified by an AI system.

You may not use the API or MCP server to abuse the Service, bypass access controls, harvest data, spam, overload infrastructure, or publish unlawful or infringing material. We may rate limit, block, or revoke API/MCP access at any time.

9. Acceptable Use

You agree not to misuse the Service. Prohibited activities include:

  • attempting to gain unauthorised access to accounts, documents, tokens, systems, or infrastructure;
  • circumventing access controls, security features, rate limits, or usage restrictions;
  • scraping, crawling, or harvesting data in bulk without permission;
  • interfering with the integrity, availability, or performance of the Service;
  • using the Service for spam, phishing, malware, impersonation, or deceptive activity; or
  • using the Service in a way that violates law or third-party rights.

10. Data, Backups, and Availability

We do not guarantee that documents, comments, versions, tokens, analytics, or other data will be stored indefinitely. The Service may be unavailable, changed, suspended, discontinued, or lose data. Keep your own copies of anything important. We are not responsible for loss of content, access, comments, versions, metadata, or integrations.

11. Privacy

Our Privacy Policy explains what personal data we collect, how we use it, and how you can request deletion or access. By using the Service, you acknowledge that we process data as described in the Privacy Policy.

12. Marketing and Attribution

The Service may include attribution such as "Created with mkdshare.dev" in API or MCP responses and document views. We may identify organisations or projects that publicly use the Service in marketing materials, unless you ask us not to. We will not use private document content in marketing without permission.

13. Intellectual Property

All rights in the Service itself, including its design, code, name, branding, and software, are owned by mkdshare.DEV and its operators. These terms do not grant you rights in the Service except the limited right to use it according to these terms.

14. Third-Party Services

The Service relies on third-party providers, including Google for authentication and device authorisation, and Render for hosting. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services, clients, AI assistants, or integrations you choose to use with mkdshare.DEV.

15. No Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not guarantee uptime, reliability, data durability, access control effectiveness, compatibility, accuracy, security, or fitness for a particular purpose.

16. Limitation of Liability

To the fullest extent permitted by law, mkdshare.DEV and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, content, profits, goodwill, access, tokens, integrations, or service availability. Our total aggregate liability for all claims relating to the Service will not exceed the amount you paid us in the twelve months before the claim. If the Service was free, that amount is zero.

17. Indemnification

You agree to indemnify and hold harmless mkdshare.DEV and its operators from claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from your content, your use of the Service, your integrations, your violation of these terms, or your violation of law or third-party rights.

18. Governing Law

These terms are governed by applicable law. Any disputes will be resolved in courts of competent jurisdiction. If any provision is found unenforceable, the remaining provisions will continue in effect.

19. Changes to These Terms

We may update these terms at any time. When we do, we will update the "Last updated" date. Continued use of the Service after changes are posted means you accept the revised terms.
